Offenses Against Unborn Children

The Problem:
Laci Peterson and her unborn son, Connor, were murdered in 2002, which prompted the signing of the federal Unborn Victims of Violence Act in 2004. Currently, prosecutors in Florida do not have the tools to use against criminal elements that would attack a pregnant woman. 

What is Offenses Against Unborn Children?
A person who engages in conduct that violates Florida Criminal Code or criminal offense defined by another statute & causes death of, or bodily injury to unborn child commits a separate offense, specifies that certain types of knowledge or intent are not necessary for such offense; provides exceptions; revises definitions & terminology. 

This bill gives additional tools for prosecutors to use against the craven elements that would attack a pregnant woman. 

It allows prosecutors to seek additional penalties, but not the death penalty. Prosecutors would be able to use their discretion to determine if it would be applicable. 

States' Experience
Currently, thirty-seven states (37), not including Florida, have passed laws have fetal homicide laws that apply to the earliest stages of pregnancy.
